Terms of Service

By completing payment for a Reserve Private Tours experience, you agree to be bound by these Terms of Service. Please read them carefully before booking.

1. The Parties

These Terms of Service constitute a binding agreement between Reserve Private Tours (ABN to be inserted), a sole trader operating in Western Australia ("we", "us", "our"), and the guest or purchasing party ("you", "the guest").

2. Booking and Deposit

All bookings are subject to availability and are confirmed only upon receipt of payment. For Founding Release individual seat bookings, full payment of $850 AUD per seat is required at the time of booking.

For private vehicle bookings, a non-refundable Curation and Securing Fee of 50% of the total booking value is required to confirm your date. This fee covers the immediate work of reserving exclusive venue access, coordinating partner arrangements, and declining other enquiries for that date. The remaining 50% balance is due no later than 14 days prior to the experience date.

In the event that we must cancel your experience due to circumstances within our control, we will offer you a full refund or a credit transferable to a future date of your choosing. In the event of cancellation due to Force Majeure (see Clause 7), a credit will be offered in lieu of a refund.

4. The Experience

Reserve Private Tours curates and hosts private wine journey experiences in the Swan Valley, Western Australia. The specific itinerary, venues, and inclusions for each experience are confirmed in writing at the time of booking. We reserve the right to substitute a venue or element of the experience with one of equivalent or superior quality in the event of unforeseen circumstances, including venue unavailability.

All experiences are approximately six hours in duration. Guests are responsible for their own travel to and from the designated departure point unless otherwise agreed in writing.

5. Guest Conduct and Responsible Service of Alcohol

Reserve Private Tours operates in compliance with the Liquor Control Act 1988 (WA) and the Responsible Service of Alcohol guidelines. We reserve the right to refuse service of alcohol to any guest who, in our reasonable judgement, is intoxicated or whose behaviour poses a risk to themselves, other guests, or our partner venues.

We further reserve the right to terminate an experience immediately, without refund, if a guest's behaviour is deemed by us to be unsafe, offensive, disrespectful to venue staff or property, or harmful to the reputation of Reserve Private Tours or our partner venues.

Guests must be 18 years of age or older to participate in any experience involving alcohol.

6. Vehicle and Transport

Where private chauffeured transport is included in your booking, a minimum cleaning and sanitation fee of $500 applies to any damage, soiling, or sanitation requirements caused by a guest. This fee will be charged to the payment method on file.

Reserve Private Tours is not liable for delays or disruptions caused by traffic, road conditions, or circumstances beyond the control of the vehicle operator.

7. Force Majeure

Neither party shall be liable for any failure or delay in performance arising from circumstances beyond their reasonable control, including but not limited to: acts of God, extreme weather events, pandemic or public health orders, government restrictions, fire, flood, or industrial action. In such circumstances, Reserve Private Tours will offer a credit transferable to a future date.

8. Liability

Reserve Private Tours holds public liability insurance. To the maximum extent permitted by law, our liability to you in connection with any experience is limited to the amount paid by you for that experience.

We are not liable for any indirect, consequential, or special loss or damage arising from your participation in an experience, including but not limited to: personal injury not caused by our negligence, loss of personal property, or changes in venue availability caused by third parties.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

9. Privacy

We collect and handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988. By making a booking, you consent to the collection and use of your information as described in that policy.

10. Photography and Discretion

Reserve Private Tours operates with the highest standard of discretion. We will not photograph, film, or identify guests without their express consent. Guests are requested to respect the privacy of fellow guests and the confidential nature of our partner venues' private areas.

11. Governing Law

These Terms of Service are governed by the laws of Western Australia and the Commonwealth of Australia. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.

12. Acceptance

Payment of the deposit or full booking amount constitutes your acceptance of these Terms of Service in full. If you do not agree to these terms, please do not proceed with your booking.
